Terms and Conditions for Hoops Capital 10K Shootout

Information on how to enter the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
The Promoter is Danforth Finance Pty Ltd (Promoter) in conjunction with Sydney Kings Basketball Club Pty Ltd (87 626 586 267) of Heritage Building B, 1 Herb Elliot Ave, Sydney Olympic Park NSW 2127.
Entries into the promotion open at 1:00am (AEDT) on Friday 30 December 2022 and closes at 11:59pm (AEDT) on Sunday 29 January 2023 (Promotional Period).
Eligibility and Entry
Entry to the promotion is open to:
Permanent Australian Residents aged 18 years or older. For the purposes of these Terms and Conditions, “Australian Resident” means a person who resides in Australia at the start of the Promotion Period and who holds Australian citizenship or holds an Australian permanent residency visa.
Individuals who are located within the the Venue during the first time-out of the second half of the Sydney Flames match on the Promotional Day. For the avoidance of doubt, the venue refers to Qudos Bank Arena (Edwin Flack Ave, Sydney Olympic Park NSW 2127).
The following are excluding from participating in the promotion:
Employees (and their immediate families) of the Promoter and agencies associated with this Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin
Professional and/or; ex/former Professional; and/or semi-professional player or coach (including assistant coaches) of the following sporting codes: NBL or NBL1
“Professional” means someone who receives monetary consideration for participating in a national league administered sport.
“Semi-Professional” means any basketball player who has a current contract with a club from the codes listed above and/or all players who are currently playing in any of the following NBL competitions: NBL or NBL1
As a condition of entering into this Competition, each entrant agrees to participate and co-operate as required in all editorial activities relating to the Competition (including but not limited to, being photographed and interviewed) and grants to Hoops Capital a perpetual, irrevocable, royalty-free licence to use such footage and photographs and their entry in any media (including, but not limited to, banners, signage, posters, television, magazine, internet, MMS, DVD or other digital or print formats) for an unlimited time for any reason.
(Collectively, Entry Requirements and Eligible Person).
Eligible Applications
There is a maximum of one (1) entry per Registration Period. The selected entrant must participate in the promotional activity. For the avoidance of doubt, the maximum number of entries for each Eligible Person who satisfied the Entry Requirements during the Promotion Period is one (1) entry into the Promotion per Eligible Person.
Up to one (1) entrant will be selected each week to participate in the Hoops Capital 10K Shootout. There will be a total of four (4) entrants selected to participate in the Hoops Capital 10K Shootout.
Entry Procedure
Contestants may only be selected once to participate in the Hoops Capital 10K Shootout.
Step 1: Registration
To register for the Promotion, contestants must be present within the Venue during the first time-out of the second half of the Sydney Flames game on the relevant Promotional Day.
Step 2: Selection of Participants (Finalist)
The Finalist will be selected to participate in the Hoops Capital 10K Shootout
The Finalist will be selected from the Eligible Entrants at random
The Finalist will be announced via the big-screen in the Venue
There is a maximum of one (1) Finalist per Registration Period. Up to one (1) entrant will be selected to participate in the Hoops Capital 10K Shootout.
If the selected Finalist does not meet the eligibility criteria, a new Finalist will be selected to participate in the Hoops Capital 10K Shootout.
Step 3: Hoops Capital 10K Shootout
The Hoops Capital 10K Shootout Finalist will participate in the Hoops Capital 10K Shootout hosted during the Sydney Kings game, which will consist of:
The Finalist will have two (2) attempts to shoot the ball directly in front of the basket, from behind the halfway line.
If the Finalist successfully shoots the ball in the basket from half-court on any one (1) occasion, they will be deemed the Prize Winner and receive the $10,000 Major Prize. For the avoidance of doubt, the shot shall only be deemed to be successful if the ball passes through the basketball ring. The ball must not touch any other surface or object once the ball has left the hands of the participant.
If the Finalist doesn’t successful shoot the ball in the basket from half court, they will receive four (4) complimentary tickets to a Sydney Flames 22-23 regular season home game of their choice at Quaycentre.
Prior to the first shot attempt, the Finalist is not permitted to take any practice attempt(s). Both the first and second shots will be videotaped.

Prize Details
The total prize pool is valued up to a maximum of AUD$30,000 (inclusive of GST).
The maximum prize pool per contestant is AUD$10,000 (inclusive of GST).

Total Prize Pool
The prize pool is $10,000 per game and $30,000 over the entire season.
As a condition of accepting the Prize, the winner may be required to sign any legal documentation as and in the form required by Hoops Capital in its absolute discretion, including, but not limited to, a legal release and indemnity form.
Prize winners will be subject to, and must abide by the terms and conditions of any third parties, including but not limited to the venues the winners will attend. Any breach of such terms and conditions may affect the ability to receive benefits of the prize. In that case, such benefits will be forfeited.
The winning entry is non-transferable or refundable or redeemable for cash.
In receiving the prize, the winners agree to participate and co-operate as required in footage relating to the Promotion, including but not limited to being interviewed and photographed. The winners may be de-identified by using first names only and the winners will have access to the footage upon request. The winners grant the Promoters a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winner will not be entitled to any compensation whatsoever for such use.
Liability:
The Sydney Kings are not liable for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, in connection with the arrangement for supply of the goods or services to the prize winner or their guests. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws.
If for any reason, this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoters, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoters reserve the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition subject to any written directions given under State Legislation.
Privacy:
Hoops Capital respects your private information. All entries remain the property of Hoops Capital. Information obtained specifically for this Competition, will only be used for the administration of this competition. The Entrants details will be handled in accordance with the NBL’s privacy policy found at http://nbl.com.au/pages/privacy-policy
By signing up to this competition, entrants also agree to be added to the Hoops Capital database and may be communicated to regarding future news, events and competitions related to Hoops Capital.
